(Cardiogenesis, we or us) is strongly committed to your right to
privacy and this Privacy Statement is incorporated into and forms a
part of the Terms of Use and the agreement you have with us concerning
your use of our Site and terms that are not defined below have the
meaning that is given them in those Terms of Use. Generally, we collect
Personal Information (i.e., personally identifiable, non-public
information) only when you use our Site and we take reasonable measures
to protect your Personal Information while it is in our care.

otherwise provide it to us, you agree to our use of such data as

Data Collection
Cardiogenesis
only collects Personal Information you voluntarily provided to us when
you use the Site. Personal Information may include data such as your
username, e-mail address and any additional information you provide,
whether at your discretion or in response to our request. We attempt to
limit the Personal Information we collect to the minimum required to
complete a visitor's transaction with us, exchange information or
otherwise provide the service you request. We make every reasonable
commercial effort to avoid excessive or irrelevant collection of

Use of Data
We
use Personal Information only for the purposes stated at the time the
information is collected or as otherwise specifically set forth in our
agreement with you (see our Terms of Use). Except with your permission
or as described in the section below titled \"Third Parties,\" or as
otherwise stated in our agreement with you, we do not share identifying
data with any nonaffiliated company. Although we may track the numbers
of Site visitors, Personal Information is not extracted in this
process. We use tracking information in the aggregate to help us
operate the Site, improve our service, and to display advertising and
marketing information. We collect Personal Information about you when
you visit and use our Site, when you enter or input information,
whether you are registering, signing up, ordering or purchasing
products or services, or during other exchanges of information,
transactions and activities when you use our Site. We may use the

Cookies
Cardiogenesis
does not currently store cookies on your PC permanently nor does it
employ cookies to transmit Personal Information. Cardiogenesis may use
session cookies, which temporarily stores information in a browser's
memory and passes that information back to the applicable server
whenever a request for a new page on the Site is made while you are
browsing our Site. The session cookie is not saved, nor written to
disk, and information in the session cookie is only valid for that one
particular session. Session cookies are discarded when the browser is
closed. Most web browsers automatically accept session cookies and
virtually all of the popular browsers today can be configured to
provide you with notice of when a session cookie (or any other cookie)
is about to be placed on the browser. No information is saved in these
session cookies other than an identification number associated with the
particular session.
Children
Our
Site is not intended for use by minors and certainly not by any
children 13 years of age or younger. Cardiogenesis does not knowingly
collect Personal Information from children and if we become aware that
a child 13 or younger has registered or is attempting to register, we
will notify them that they are not eligible for registration, or if
they have already registered, we will cancel their registration and
attempt to expunge all Personal Information that we can identify may
have been previously collected unknowingly, from our records.
Third Parties
As
you can appreciate, we cannot fully ensure your Personal Information
will not be disclosed to third parties. For example, we may be required
to provide information to a governmental agency or a court; or third
parties may unlawfully intercept or access transmissions. Additionally,
we may (and you authorize us to) disclose your Personal Information to
private entities, law enforcement or other government officials as we,
in our sole discretion, believe necessary or appropriate to investigate
or resolve possible problems, to protect our business and assets and to
comply with our legal and regulatory obligations. In general, it is our

compile, maintain or retain Personal Information for dissemination or

Hyperlinked Sites, our Privacy Statement no longer applies and you will
be governed by whatever terms of use, conditions and privacy practices

non-public information.
Access
You
have the right to know and review the accuracy of any Personal
Information you have submitted to Cardiogenesis through the Site.
Inquiries about the accuracy of Personal Information, or requests to
have Personal Information removed from our records, should be directed

We do not assume responsibility for verifying the ongoing accuracy of
Personal Information and you should notify us whenever any of the
Personal Information you have submitted changes, since keeping it

YOUR CALIFORNIA PRIVACY RIGHTS
If
you are a resident of the State of California, under a new provision of
the California Civil Code, have the right to request from us, because
we conduct business in California, a list of all third parties to which
we have disclosed Personal Information during the preceding year for
direct marketing purposes. Alternatively, the law provides that if we
have a privacy policy that provides either an opt-out or opt-in choice
for use of your Personal Information by third parties (such as
advertisers or affiliated companies) for marketing purposes, we may
instead provide you with information on how to exercise your disclosure

Although
Cardiogenesis would qualify for the alternative option if it provided
Personal Information to third parties for direct marketing purposes
because it does have a comprehensive privacy policy and Cardiogenesis
would not be required to maintain or disclose a list of the third
parties that received your personally identifiable information for
marketing purposes during the preceding year, as noted above,
Cardiogenesis does not provide your Personal Information to any
